Empire State Bank takes its clients' financial privacy very seriously. Empire State Bank is committed to protecting the privacy of its customers and potential customers. We are committed to safeguarding your account, transaction, and nonpublic personal information. Such information is considered confidential. If you terminate your relationship with Empire State Bank your information will still be kept confidential.

Our Internet Banking product uses industry approved security technology such as passwords, firewalls and encryption, to protect customer information from tampering. Everyone servicing your relationship and accounts is required to comply with established policies at Empire State Bank. We do not disclose any nonpublic personal information about you to anyone, except as required by law.

INFORMATION WE COLLECT ABOUT YOU

We collect nonpublic personal information about you from the following sources:
      (i)         information we receive from you on applications or other forms;
      (ii)        information about your transactions with affiliates, or others; and
      (iii)       information we receive from a consumer reporting agency.

NO DISCLOSURES OUTSIDE OF EXCEPTIONS

We do not disclose any nonpublic information about our customers or former customers to anyone, except as permitted by law.

We do not disclose the following information to companies that perform marketing services on our behalf or to other financial institutions with whom we have joint marketing agreements; (i) information we receive from you on applications or other forms, such as your name, address, social security number, assets and income; (ii) information about your transactions with us, our affiliates, or others, such as your payment history or loan balance; (iii) information we receive from a consumer reporting agency, such as your credit worthiness, credit score, or credit history. We do not disclose nonpublic personal information about you to nonaffiliated third parties.

If you notify us that any information is incorrect, we will review it promptly and make all appropriate corrections to our records.
